Appeal obligates prosecution to summon al-Syani case fugitives

In an appeal made by the defense for the al-Syani criminal case to the Appeal Court, the prosecution was obligated to inform fugitives, Rafiq al-Qadhi, Najib Ahsan al-Najar and Yahiya Ali Aidh, to appear before the court. 

The court session was presided by Judge Mohammed al-Hakimi and the membership of Judges Najib al-Faqih and Mose’d al-Omisi. The case involved accusations against 15 suspects for forming an armed gang for kidnapping and killing in the capital secretariat. 

The court heard the prosecution statement submitted by Judge Saeed al-Aqil as general prosecutor for appealing the case. The prosecution explained that it referred 10 of the suspects for armed kidnapping, detaining and torturing to death the deceased Abdulhakem Hussein Mohammed al-Syani. 

According to confessions and investigations, the gang detained al-Saini in a room at suspect’s Yahya Aidh’s home for ten days, then took his body to a car to Bani Matar area and rolled the car down the hill with the dead body, after pouring petrol and setting fire to it attempts to hide their crime.

The prosecution said that the case’s crime was proved by the suspects’ confession, which coincides with the facts, adding that they committed one of the ugliest crimes seen in Yemen recently. 

The prosecution also called for altering the appealed primary court’s ruling in order that they should receive the utmost punishment.

The primary court ruled that the suspects should receive 2-5 years imprisonment and drop the relatives’ special right due to their relinquishment. 

Aidah Yahiya, and the wife of the victim, Hafiza Ahmed Naji al-Shokani, are charged with organizing the crime and conspired with the other suspects for committing the kidnapping crime. 

Among the other charges, the prosecution’s also charged one suspect as an accomplish in helping carry out the crime and another two suspects charged for willfully committing shameful actions, contradicting the marriage honor. 

In addition to the crime at hand, the prosecution charged one suspect of possessing 17 phonographic CDs and films and three more were charged for stealing the victim’s money and for carrying unlicensed weapons, grenades, and ammunition.
